The order of September 8, 19999 is an order implementing article 11 of decree no. 73-138 of February 12, 1973 as amended.

This order lists the constituents authorized in cleaning products for materials and objects intended to be brought into contact with foodstuffs. Authorized constituents may be accompanied by restrictions on use (maximum and minimum concentrations in cleaning products, conditions of use) and purity criteria.

This decree was amended by the decree of December 19, 2013.

Amendments

The order of December 19, 2013 modifies the lists of substances authorized in cleaning products for materials and objects intended for contact with foodstuffs in particular by:

  • the withdrawal of biocidal substances covered by Regulation (EU) No. 528/2012 of May 22, 2012 concerning the making available on the market and use of biocidal products;
  • the removal of substances classified as carcinogenic, mutagenic or toxic to reproduction categories 1A and 1B according to Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006.

Guidelines for substance authorization applications

The instruction of August 27, 1986 relates to applications for authorization to use products intended for cleaning materials; it details the examination of application files and comes in application of decree no. 73-138 of February 12, 1973, as amended, implementing the law of August 1er 1905 on fraud and falsification with regard to processes and products used for cleaning materials and objects intended to come into contact with foodstuffs, products and beverages for human and animal consumption.

The French Food Safety Agency's opinion of August 2, 2007 takes stock of the health risks of cleaning products for materials and objects intended to come into contact with foodstuffs. It gives recommendations on the information that the agency considers should be provided in applications for authorization of constituents of cleaning products for materials and articles intended to come into contact with foodstuffs. These recommendations complement the Instruction of August 27, 1986.
