This decree sets the requirements to be met by rubber materials and objects placed or intended to be placed in contact with foodstuffs, products and beverages intended for human or animal consumption and pacifiers and teats for infants and young children. It replaces and repeals the order of 9 November 1994 relating to rubber materials and objects in contact with foodstuffs, products and beverages.

The following are subject to the provisions of this order:

  • rubber materials and articles intended to come into contact with foodstuffs within the meaning of framework Regulation (EC) No. 1935/2004;
  • rubber soothers for infants and young children hereinafter referred to as "rubber materials and articles", as well as intermediate materials and substances used in their manufacture;
  • bottle teats and pacifiers for infants and young children made of elastomer or rubber whenever they are specifically mentioned.

The revisions made are as follows:

  • Updating the lists of authorized constituents in rubber materials and articles intended to come into contact with foodstuffs and pacifiers for infants and young children, as well as the restrictions and specifications applicable to these constituents, taking into account developments in scientific knowledge;
  • .
  • Clarification and updating of certain rules for verifying the conformity of rubber materials and articles;
  • Proposal of a model for the declaration of conformity (in Appendix V) provided for in Article 6 of Decree 2007-766 of May 10, 2007.

The provisions of this order come into force on 1 July 2021. Rubber materials and articles placed on the market for the first time before 1er July 2021, complying with the order of November 9, 1994 before that date, may be marketed until stocks are exhausted.
